TERMS AND CONDITIONS (version updated in accordance with current Romanian legislation – January 2026)

1. General overview and identification details of the trader Welcome to codrudepaine.ro! The website and online store are hosted and operated via the Shopify platform; however, the sales contract is concluded directly between you (the consumer) and [COMPANY NAME].

These Terms and Conditions (“Terms”), together with the Privacy Policy [LINK] and the Refund/Return Policy [LINK], govern access to and use of the website as well as the conclusion of distance sales contracts for the products offered.

By placing an order and checking the box to accept the Terms (or by continuing to use the website after they are displayed), you agree to these Terms. If you do not agree, please do not use the website or place orders.

2. Mandatory pre-contractual information (pursuant to OUG 34/2014) Before placing an order, you are entitled to receive the following essential information (most of which is displayed on product pages, cart, and checkout):

  • main characteristics of the products;
  • total price (including VAT and all taxes);
  • additional delivery, shipping, customs duties (if applicable);
  • payment methods, delivery, and performance;
  • validity period of the offer/price;
  • right of withdrawal (14 days) and conditions for exercising it (detailed below);
  • registered office address and contact details;
  • legal conformity guarantee (minimum 2 years);
  • contract duration (if applicable) and termination conditions.

If any information is unclear on the website, please contact us before ordering.

3. Account and access To place orders, you may create an account or order as a guest. You are responsible for the accuracy of the information provided and for the security of your account. You may not share your login credentials.

4. Products and descriptions We make every effort to provide accurate descriptions and images; however, colors may vary depending on your device. We do not guarantee that the product will appear identical on screen. Descriptions and stock availability may be changed without prior notice.

5. Orders and contract conclusion Placing an order constitutes a firm offer from you. The contract is concluded only upon receipt of the confirmation e-mail accepting the order and payment processing (if payment is online).

We reserve the right to refuse/partially refuse an order (e.g., out of stock, pricing errors, legitimate reasons). We will inform you promptly.

6. Prices, billing, and payment methods Displayed prices include VAT. Delivery costs and other additional fees are shown separately before order completion.

7. Delivery and transfer of risk Delivery is made through partner couriers. Delivery times are estimates only. 8. Right of withdrawal (14 days – OUG 34/2014) You have the right to withdraw from the contract without giving any reason within 14 days from the day on which you or a third party indicated by you (other than the carrier) acquires physical possession of the last product ordered.

To exercise the right of withdrawal, you must inform us by means of an unequivocal statement (e.g., e-mail to marketing@codrudepaine.ro or using the withdrawal form [LINK]) before the 14-day period expires.

Consequences of withdrawal:

  • We will reimburse all payments received (including the cost of standard delivery – not express delivery if chosen) within 14 days from the date of receipt of your withdrawal notification, using the same means of payment (unless otherwise agreed).
  • You must return the products within 14 days from notifying withdrawal, bearing the cost of return (unless we agree to cover it).
  • You are only liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the products.

Exceptions to the right of withdrawal (Art. 16 of OUG 34/2014): personalized products, sealed products that cannot be returned for hygiene/health reasons after unsealing (e.g., unsealed food, unsealed cosmetics), products that become inseparable after delivery, etc. Such exceptions are clearly indicated on the product page if applicable.

9. Legal conformity guarantee All products benefit from a legal guarantee of conformity of at least 2 years (Law 449/2003). In case of non-conformity, you are entitled to repair, replacement, proportionate price reduction, or contract termination, under the conditions of the law.

Any additional commercial guarantees (if offered) do not affect the legal guarantee.

10. Returns and refunds Full details are provided in the Return Policy [LINK], which complements these Terms.

11. Intellectual property All elements of the website (texts, images, logos, etc.) are protected by copyright and/or trademarks. Their use without written consent is prohibited.

12. Liability and limitations Our liability is limited in accordance with Romanian law. We are not liable for indirect, consequential, or punitive damages, except in cases of gross negligence or willful misconduct.

Information on the website is for informational purposes; we do not guarantee the absence of errors.

13. Personal data processing Your data is processed in accordance with the Privacy Policy [LINK] and GDPR.

14. Dispute resolution Disputes shall be resolved amicably. If not possible, the competent courts are those in Romania (our registered office/domicile).

You have the right to alternative dispute resolution via the ODR platform or accredited ANPC entities.

15. Changes to the Terms We reserve the right to amend the Terms. Substantial changes will be notified on the website and/or by e-mail. Continued use after changes constitutes acceptance of the new Terms.
